cusper — Terms of Use
The short version
cusper is a reality shifting companion app for iPhone. By installing or using it, you agree to these terms. They are written to be readable — keep them with the privacy policy as a pair.
You get a personal, non-commercial right to use the app on your Apple devices. You own what you write inside it. Subscriptions auto-renew through your Apple ID until you cancel. Apple handles every payment; we never see your card details. Reality shifting is a practice, not a guarantee — cusper is a companion to that practice, nothing more.
The rest of this document is detail.
Who these terms are between
These terms are a binding agreement between you and Penjuru Pikiran ("we", "us"), the developer and publisher of cusper. Penjuru Pikiran is a sole proprietorship contactable at [email protected].
If you do not agree to these terms, do not install or use cusper. If you stop agreeing at any point, the remedy is to delete the app from your devices.
What you can do with cusper
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use cusper on iPhones and iPads that you own or control, in accordance with Apple's App Store Licensed Application End User License Agreement ("Apple's standard EULA"). These terms supplement Apple's standard EULA; where they conflict, these terms govern as to the cusper-specific provisions, and Apple's standard EULA governs everything else.
You may use cusper for your own personal, non-commercial reality shifting practice. That includes scripting realities, journaling dreams and waking practice, recording voice memos, attaching photos, scheduling simulated notifications for yourself, and using the methods, subliminals, and other features as designed.
You may not:
- Resell, sublicense, or rent the app or your access to it
- Reverse-engineer, decompile, or attempt to extract the source code, except to the limited extent allowed by applicable law
- Use the app to send unsolicited messages, harass anyone, or impersonate real people (the simulated-notifications feature is for messages to yourself, not for messaging or pranking others)
- Use the app to violate any law, anyone's rights, or Apple's App Store guidelines
What you create stays yours
Everything you write, record, attach, or compose inside cusper is yours. You retain all rights to your realities, scripts, journal entries, voice memos, photos, and simulated notifications. We do not claim ownership over any of it, and we do not use it to train models or improve services. Where it lives, and how it stays private, is described in the privacy policy.
If you turn on iCloud sync, your text-shaped records sync through your own iCloud account under Apple's terms. We never receive or hold those records.
Subscriptions, pricing, and auto-renewal
cusper offers four paid options through the App Store:
| Plan | Price | Renewal |
|---|---|---|
| Weekly | $9.99 / week | Auto-renews weekly |
| Yearly | $49.99 / year | Auto-renews yearly |
| Yearly (offered on cancel) | $39.99 / year | Auto-renews yearly |
| Lifetime | $69.99 | One-time, no renewal |
All prices are in US dollars. Prices in your local currency may differ based on Apple's regional pricing. Apple may adjust regional prices over time; you will see the price for your region at the point of purchase before you confirm.
Auto-renewing subscriptions (weekly and either yearly tier) renew automatically at the end of each billing period unless canceled at least 24 hours before the end of the current period. Renewal is charged to your Apple ID account within 24 hours of the end of the current period at the price of the chosen plan.
You can manage and cancel your subscription at any time in your Apple ID account settings (Settings → [your name] → Subscriptions). Canceling stops the next renewal but does not refund the current period.
Lifetime is a one-time in-app purchase. It does not renew, and it does not expire. If you subscribe to a weekly or yearly plan and later purchase Lifetime, your subscription continues running until the end of its paid period; you can cancel it through Apple at any time after the Lifetime purchase to stop further renewals.
Refunds are handled by Apple, not by us. Requests go through reportaproblem.apple.com under your Apple ID.
Restore purchase: if you reinstall cusper or sign in on a new device with the same Apple ID, the paywall's restore purchase link will re-grant your entitlement. We do not store payment records on a server.
Free use and feature access
cusper has a free tier. You can use the app to script realities, journal, record voice memos, and use the built-in methods without a subscription. Some features are gated behind a paid plan. Which features are gated is listed inside the app at the point of access, and may change over time as the product evolves.
If we move a feature from free to paid, we will say so in the in-app release notes for that update. We will not move a feature you have already used heavily into paid-only without notice.
Reality shifting is a practice
cusper exists to support a personal practice. We make no claim — express, implied, or otherwise — that reality shifting produces any specific outcome, sensation, or change in your life. The benefits we point to are the benefits of practice itself: attention, intention, and reflection.
Nothing in cusper is medical, psychological, psychiatric, or therapeutic advice. cusper is not a substitute for sleep, for professional mental health care, or for any other care you may need. If you experience distress, intrusive imagery, sleep disruption, or any other symptom that worries you, please pause the practice and speak with a qualified professional.
You are responsible for your own well-being while using cusper. Don't practice while operating a vehicle or any task that requires your full attention.
Simulated notifications and content responsibility
cusper lets you compose simulated messages, addressed to yourself, that fire on your own device. Whatever you type stays on your device and never reaches another person.
You are responsible for what you write. Please respect the privacy of others — do not use real names, real photos, or real identifying information of people who have not agreed to be referenced. The in-app reminder is a nudge, not a legal substitute for consent.
cusper is not a platform for messaging others, prank-texting, or social manipulation, and using its simulated-notification feature for those purposes is a violation of these terms.
App Store-specific provisions
Some clauses apply specifically because cusper is distributed through Apple's App Store. The full set is in Apple's standard EULA (linked above); these are the key points:
- Apple is not a party to these terms between you and us, but Apple is a third-party beneficiary entitled to enforce them.
- Maintenance and support for cusper is provided by us, not by Apple. Apple has no obligation to provide it.
- Warranty: to the maximum extent permitted by law, Apple disclaims all warranties for cusper. If cusper fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; beyond that refund, Apple has no other warranty obligation for cusper, and any other claims, losses, or expenses attributable to a failure to conform are our responsibility.
- Product claims: claims relating to cusper itself (including product liability, failure to conform to legal requirements, and consumer-protection claims) are between you and us, not Apple.
- Intellectual property: in the event of any third-party claim that cusper or your use of it infringes that party's intellectual property rights, we — not Apple — are responsible for the investigation, defense, settlement, and discharge of any such claim.
- Export compliance: you represent that you are not in a country subject to a US government embargo, and that you are not on any US government list of prohibited or restricted parties.
- Government end users: cusper and related documentation are "Commercial Items" as defined in the relevant US government acquisition regulations.
Privacy
The privacy policy at https://misykat.dev/cusper/privacy-policy/ describes what data cusper handles, where it lives, and what we don't do with it. The short version: cusper runs on your phone; we don't operate servers, accounts, or analytics; payment is handled by Apple. Read the policy for the full posture.
Updates to cusper
We may release updates that fix issues, change features, or introduce new ones. Some updates will be required to keep the app functioning correctly; others are optional. When a required update changes how the app works in a way that affects your stored data, we will surface a notice inside the app before the change takes effect.
We may also retire features over time. If we retire a paid feature, you will see notice in the in-app release notes for that update.
Disclaimers and limits
cusper is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise — including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or available at any particular time, or that defects will be corrected.
To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to cusper or these terms — whether in contract, tort, statute, or otherwise — will not exceed the greater of (a) the amount you paid us for cusper in the twelve months preceding the claim, or (b) twenty United States dollars (US$20). In no event will we be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or loss of goodwill, even if we have been advised of the possibility of such damages.
Some jurisdictions don't allow the exclusion or limitation of certain warranties or damages. To the extent those laws apply to you, parts of the above may not apply, and you may have additional rights.
Termination
These terms apply from the moment you install cusper and continue until they are terminated.
You can terminate them at any time by deleting the app from all of your devices and canceling any active subscription through Apple. We can terminate them if you materially breach these terms — for example, by using the simulated-notifications feature to message other people, or by attempting to reverse-engineer the app. Termination by us is rare and we will give you a chance to fix the problem first where it is reasonable to do so.
On termination, your license to use cusper ends. The privacy policy continues to apply to any data that remains on your device or in your iCloud account; you can remove that data as described in the privacy policy.
Sections that should reasonably survive termination — including the content-ownership clause, the disclaimers, the limit of liability, and the dispute clauses — survive.
Changes to these terms
If we change these terms, we will update the effective date at the top. If the change is material — meaning it meaningfully affects your rights or obligations — we will surface a notice inside the app before the change takes effect, and (where reasonable) ask you to acknowledge the new terms before continuing to use the app. Continued use of the app after a material change means you accept the new terms; if you do not, the remedy is to delete the app and cancel any active subscription.
Governing law and disputes
These terms are governed by the laws of the Republic of Indonesia, without regard to its conflict-of-law rules. Mandatory consumer-protection laws of your country of residence still apply to you to the extent they are mandatory under local law.
Any dispute arising out of or relating to these terms or your use of cusper will be resolved, first, by good-faith discussion at [email protected]. If that fails, the dispute will be resolved in the competent courts of Indonesia, except where applicable mandatory law requires otherwise (for example, EU consumers have the right to bring proceedings in the courts of their country of residence).
Apple-specific disputes — those that relate to your acquisition of cusper through the App Store rather than to our relationship with you — are governed by your agreement with Apple.
Severability and entire agreement
If any provision of these terms is found unenforceable, the rest remains in effect, and the unenforceable provision will be reformed only to the minimum extent needed to make it enforceable.
These terms, together with the privacy policy and Apple's standard EULA, are the entire agreement between you and us about cusper and supersede any prior agreement or understanding on the same subject.
